§ 94.16. MAINTENANCE.

  • (A) The owner of any real property is liable, at his or her expense, to maintain that portion of any sidewalk, curb and/or tree row area abutting on or passing through his or her property in a good, safe and usable condition.
    (B) This requirement includes, but is not limited to, the following:
    (1) Repairing any substantial cracks or holes in the concrete;
    (2) Removal of sticks, branches of trees or other vegetation, debris or obstacles which render the use of the sidewalk inconvenient or hazardous; and
    (3) Trimming or removal of trees or vegetation that create a safety hazard to pedestrians, street traffic or adjacent properties.
