§ 94.17. FAILURE TO MAINTAIN.

  • (A) If a property owner fails to maintain or repair a sidewalk, curb or tree row area, notice by mail to the owner as the name appears on the Assessor’s books of the county may be given by a member of the Board of Works, head of the Street Department or designee of the Board of Works.
    (B) A property owner has 30 days from the date of notice to make the necessary repairs as required by the notice.
    (C) If the property owner fails to comply with the notice, the Board of Works may have the sidewalk and/or curb constructed or repaired by an independent contractor or vegetation trimmed or removed by an independent contractor.
    (D) The costs of repairs by the contractor shall be assessed to the property owner and lien against the property may be recorded. If the repair bill remains unpaid for 30 days, the Board of Works may direct the City Attorney to collect and enforce payment of the lien with interest and costs including attorney fees.
